Privacy policy

This privacy policy (the “Privacy Policy”) governs the manner in which DuraClim Inc. (“DuraClim Inc.”) collects, uses, maintains and discloses information collected from users (each, a “User”) of its www.duraclim.com website, applications and technology platform, and any derivative or affiliated websites on which this Privacy Policy is posted (collectively, the “Site”). The Site is owned and operated by DuraClim Inc. Please note that this Privacy Policy covers DuraClim Inc.’s practices regarding information collected on its Site.

Consent to Communications

You acknowledge that the Consent to Communications section of this Agreement does not apply to you unless you have given your Express Written Consent (as defined above) to this Agreement. If you have provided your Express Written Consent (as defined above), the following Consent to Communications terms are binding on you.

a) Agreement to Receive Communications from the Company

By using the Platform and providing your phone number and/or email address, you agree and acknowledge that the Company may communicate with you via email, text messages, text receipts, Short Messaging Service (“SMS”), fax, and phone calls to the number you provided. These communications may serve any purpose, including marketing, matters related to Tutors and Services provided to Tutors, and matters concerning Students and Services provided to Students. They may use any available methods, both known and those developed in the future, including, but not limited to, auto-dialers, automated messages, prerecorded messages, general telemarketing practices, and other electronic communications. You agree that these calls may include products and/or services marketed by the Company, and you are not obligated to receive these calls to purchase such products and/or services. The Company will not charge you for sending SMS messages, but your communication provider may. You agree to cover any fees or charges incurred for incoming and outgoing messages to or from the Company or its assignees, successors, or agents, without reimbursement.

You understand that if the provided phone number ceases to be a valid contact or if you are no longer its owner, you must inform the Company by email at [email protected]. You understand and agree that if the Company sends a communication but you do not receive it because your email address or phone number is incorrect, outdated, blocked by your provider, or otherwise inaccessible, the Company will still be considered to have provided the communication. Note that if you use a spam filter that blocks or redirects emails from unknown senders, you should add the Company to your address book to ensure you receive all communications sent to you.

By electronically providing your Express Written Consent for this communication consent, you confirm your acceptance of these terms and conditions and acknowledge that you have had the opportunity to download or print a copy of the Agreement for your records.

b) Electronic Signature

You acknowledge that by clicking “I Accept,” “Send,” “Submit,” or a similar button on the Company’s website, you are indicating your intent to sign the relevant document or record, which will serve as your signature.

c) How to Withdraw Your Consent to Communications

You acknowledge that you may withdraw this consent by notifying the Company (following the opt-out instructions below or using the opt-out option provided in each communication) and by repeating the revocation if the Company attempts further communication. Until this consent is revoked and, if necessary, repeated, you may still receive calls from the Company at the provided number.

To withdraw consent to communications, you may write to the Company at: [email protected].

To unsubscribe from promotional emails, you may follow the unsubscribe options within the promotional email. To unsubscribe from promotional texts, reply to the number from which you received the message with “STOP” from the device receiving the messages. To unsubscribe from promotional calls, you may follow the prompt after the call or text “STOP” to the number from which you received the call from the receiving device. You acknowledge that agreeing to receive texts or calls for promotional purposes is not a condition of using the Platform or Service. You understand that opting out of calls and/or texts may impact your experience on the Platform or Service. At its discretion, the Company may treat an invalid or malfunctioning phone number as a withdrawal of consent to receive SMS messages. No fee will be imposed for processing your withdrawal of consent. Withdrawal of consent will take effect only after the Company has had a reasonable time to process it.

d) Request for Paper Copies of Electronic Communications

Upon request, the Company will send you a paper copy of contracts or other material provided electronically under this consent. If you want a paper copy of any of these materials, write to [email protected] within 30 days of the communication for which you are requesting a paper copy. No charge will apply for a paper copy.

e) Miscellaneous

You agree to indemnify, defend, and hold the Company harmless from any claims, losses, liabilities, costs, and expenses (including reasonable attorney’s fees) arising from providing a phone number that is not your own or from violating any applicable federal, state, or local laws, regulations, or ordinances. Your obligations under this section, which are binding only if you have provided your Express Written Consent, will survive the termination of the Agreement. The Company will not be liable for losses or damages from delays in delivery or disclosure of information to third parties by your communication service provider. The Company may change or end its text messaging service periodically, for any reason, and without notice, including terminating text messaging with or without notice and without liability to you, any other User, or third party.

 

 

Information DuraClim Inc. collects and receives

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging (SMS/MMS) originator opt-in data and consent; this information will not be shared with any third parties.

Like most web site operators, DuraClim Inc. collects non-personal information of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor request. Our purpose in collecting non-personal information is to better understand how our visitors use our site.

Some visitors to the DuraClim Inc. site choose to interact with us in ways that require us to gather personally-identifying information, such as name, e-mail address and/or phone number. The amount and type of information we collect depends on the nature of the interaction.

Individuals who conduct transactions with us online, for example by creating an account with us or purchasing products or services, are asked to provide additional information, such as personal and financial information required to process those transactions.

We record usage data when you visit or use our site, including third-party applications and platforms. DuraClim Inc. also collects potentially identifying information such as Internet Protocol (IP) addresses. We do not use this information to identify our visitors, however, and do not disclose this information except under the same circumstances that we use and disclose personally identifiable information, as described below. A user who browses the site without opening an account or providing personally identifiable information to DuraClim Inc. does so anonymously.

DuraClim Inc. may collect personally identifiable information from its customers in a variety of ways. Personally identifiable information may include (i) contact data (such as a customer’s name, phone number, postal and e-mail addresses); (ii) financial data (such as a customer’s credit card number); and (iii) demographic data (such as a customer’s zip code, age and e-mail address). If you communicate with DuraClim Inc. by e-mail, if you post messages on our various social networks, if you make telephone or cell phone calls, if you communicate through electronic or other interactive devices, if you complete online forms, surveys or contest entries, or if you communicate with DuraClim Inc. by any means, any information provided in connection with such communication may be collected by DuraClim Inc. DuraClim Inc. may also collect information about how customers use our site, for example, by tracking the number of unique views received by pages on the site, or the domains from which customers originate.

 

Information sharing

It is DuraClim Inc.’s policy to respect your privacy regarding any information we may collect through the site, by e-mail, by telephone or through any other communication we have with you. We treat the confidential information you share with us, such as your address and any financial information, with the utmost respect. Under no circumstances will DuraClim Inc. disclose customer records except as required by applicable law. DuraClim Inc. may also share information with third-party companies that process payments on our behalf, help us develop our business, inform our marketing strategy, provide online storage services, provide professional services, and provide communications software.

In each case, we collect such information only to the extent necessary or appropriate to fulfill the purpose of the user’s interaction with DuraClim Inc. We do not disclose personally identifiable information other than as described herein and below in the “How DuraClim Inc. uses information” section. Users may always decline to provide personally identifiable information, provided that doing so may prevent them from engaging in certain site-related activities.

 

Tracking technologies

DuraClim Inc. and our analytics and marketing providers use technologies such as cookies, beacons, tags and scripts, to analyze trends, administer the site, track users’ movements around the site, and gather demographic information about our user base as a whole. We may receive reports based on the use of these technologies by these companies on an individual and aggregated basis.

We use cookies to track page views/usage (log data), service metadata, device information, location information, information on user settings and for authentication. Each user can control the use of cookies at browser level. If you reject cookies, you can still use our site, but your ability to use certain functions or areas of our site may be limited.

We implement Google Analytics features that use display advertising information for Google Analytics demographic and interest reporting.

We, as well as third-party providers (including Google), use first-party cookies (such as Google Analytics cookies) and third-party cookies (such as DoubleClick cookies) to report how your ad impressions, other uses of advertising services and interactions with those ad impressions and advertising services relate to visits to our website. LSOs

Third parties, with whom we partner to provide certain features on our site or to display advertisements based on your web browsing activity, use LSOs such as HTML 5 to collect and store information. Different browsers may offer their own management tools for removing HTML5 LSOs.

 

Behavioral targeting

We partner with a third-party ad network to display advertising on our site or to manage our advertising on other sites. Our ad network partner uses cookies and Web beacons to collect non-personal information about your activities on this and other Web sites in order to provide you with targeted advertising based on your interests.

 

How does DuraClim Inc. use the information?

DuraClim Inc. may use personally identifiable information collected through the site for the specific purposes for which the information was collected, to communicate to users about products and services offered by DuraClim Inc. its parent, subsidiaries and trusted affiliates, and to improve users’ experience with DuraClim Inc. Out of respect for your privacy, you may choose to stop receiving these marketing e-mails by following the unsubscribe instructions included in these e-mails. DuraClim Inc. may also use information collected through the site for research regarding site effectiveness and business planning, marketing, advertising and sales efforts of DuraClim Inc. its parent, subsidiaries and trusted affiliates.

DuraClim Inc. may disclose personally identifiable information collected from users to its parent, subsidiaries and other related companies, trusted affiliates, independent contractors and business partners who will use the information for the purposes described above, as necessary to provide the services offered by or through DuraClim Inc. and to provide the site itself, and for the specific purposes for which the information was collected. These companies are not authorized to use your personally identifiable information in any other manner.

DuraClim Inc. may also disclose aggregate, anonymous data based on information collected from users to potential investors and partners. Finally, DuraClim Inc. may disclose or transfer personally identifiable information collected from users in connection with or in contemplation of a sale of its assets or business or a merger, consolidation or other reorganization of its business.

 

Correction, update, access or deletion of personal information

To the extent possible, if a customer’s personally identifiable information changes (such as a customer’s zip code), or if a customer no longer wishes to receive non-account specific information from DuraClim Inc, DuraClim Inc, will endeavor to provide a means to correct, update, delete and/or remove personal data previously provided by that cleint.

In addition, you may request access to personally identifiable information as collected by DuraClim Inc. by sending a request to DuraClim Inc. via email to [email protected]. We will respond to your request within a reasonable time, or otherwise in accordance with applicable law. We will retain your information for as long as your account is active or as long as necessary to provide services to you. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes and enforce our agreements.

 

Legal Notice

DuraClim Inc. may disclose personally identifiable information at the request of law enforcement or government agencies or in response to subpoenas, court orders, or other legal process, to establish, protect or exercise the legal or other rights of DuraClim Inc. or to defend against legal claims or as otherwise required or permitted by law. DuraClim Inc. may disclose personally identifiable information in order to protect the rights, property or safety of a user or any other person. DuraClim Inc. may disclose personally identifiable information to investigate or prevent any breach by the user of any contractual or other relationship with DuraClim Inc. or the commission of any illegal or harmful activity.

 

Information security

DuraClim Inc. discloses potentially personally-identifying and personally-identifying information only to those of its employees, contractors and affiliated organizations that (i) need to know that information in order to process transactions on our behalf or provide services, and (ii) have agreed not to disclose it to others. We take all measures reasonably necessary to protect against the unauthorized access, use, alteration or destruction of potentially personally-identifying and personally-identifying information.

All customer information stored on DuraClim Inc. systems is protected using industry standard security measures. We follow generally accepted standards to protect personal information submitted to us, both during transmission and once it is received.
